The purpose of the present general terms of use (called ” GCU “) is to provide a legal framework for the terms of use of the site and services by Ciel et Terre International and to define the conditions of access and use of the services by the ” User “.
These GCU are accessible on the site under the heading “GCU”.
Article 1 – Legal notice

The site is accessible free of charge at any location to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are at his/her expense.
Article 3 – Intellectual property
The brands, logos, signs and all the contents of the site (texts, images, sound…) are protected by the Intellectual Property Code and more particularly by copyright.
The Ciel et Terre brand is a registered trademark of Ciel et Terre International, SAS. Any representation and/or reproduction and/or exploitation of this trademark, in whole or in part, of any kind whatsoever, is totally prohibited.
The User must request prior authorization from the site for any reproduction, publication, copy of the various contents. The User undertakes to use the contents of the site in a strictly private context, any use for commercial and advertising purposes is strictly prohibited.
Any total or partial representation of this site by any process whatsoever, without the express permission of the operator of the website would constitute an infringement punishable by Article L 335-2 and following of the Code of Intellectual Property.
It is recalled in accordance with Article L122-5 of the Code of Intellectual Property that the User who reproduces, copies or publishes the protected content must cite the author and its source.
Article 4 – Responsibility

French law applies to this contract. In the event of failure to resolve a dispute between the parties amicably, the French courts within the jurisdiction of the Douai Court of Appeal shall have sole jurisdiction.

Article 5 – Protection of personal data
Beforehand, it should be recalled that personal data are considered as being the object of the present protection, any information relating to an identified or identifiable individual.
Thus, data concerning companies or commercial companies are excluded in principle.
Article 5.1 – Collection of personal data
When connecting to the Website, and depending on the services used, the User may be asked for a set of information concerning him/her (surname, first name, email address, telephone number, postal address).
The personal data collected are appropriate, relevant and limited to what is necessary for the purposes for which they are processed.
The information collected by the Sky & Earth, allows the User:
- To benefit from a newsletter ;
- To consult and apply for current job offers within the Company ;
- To report any project for the installation of energy solutions offered by the Company and in particular to check its eligibility;
- To be contacted by an employee of the Company in order to allow the study of the feasibility of the Customer’s project
Article 5.2 – Purposes pursued by the processing of personal data
In the context of compliance with the rules enacted by the General Data Protection Regulation (RGPD) that came into force on 25 May 2018, the User is informed that all data collected are collected as part of an overall objective of improving the User and/or Customer experience as well as for commercial and statistical purposes that are framed and only benefit sister companies, the parent company, and/or subsidiaries of the Company, unless the Holder expressly objects to the DPO (data protection referent).
The data collected is not sold to companies or persons other than those mentioned above.
The data is used to answer questions from any User following contact via the contact forms to submit a project request, an application for a job offer published on the Site and a speculative application.
They also allow the integration of any User who requests it via the Site into the database used to send newsletters.
Article 5.3 – Security measures
Ciel & Terre guarantees to the User that all the partners with whom it is brought to work respect the principles enacted by the RGPD. The company has appointed a DPO (data protection referent) to ensure the correct compliance of its obligations. The data is subject to encryption in accordance with the RGPD legislation.
Article 5.4 : Rights of the User
As such, under the General Data Protection Regulation (RGPD) the User is informed of the various rights concerning his personal data:
- The right to access and rectify his personal data;
- The right to modify, or limit personal data ;
- The right to be forgotten;
- The right to object to the processing of personal data ;
- The right to portability of personal data allowing the transfer of the latter on a usable medium to any person of their choice, upon request.

Any complaint can be brought to the control authority (CNIL today).
By the “Need help” service (https://www.cnil.fr/) which will allow you to access the complaint form at the bottom of an answer to a question.

The personal information collected is in no case entrusted to third parties except for the possible proper execution of the service ordered by the user.
The data collected is kept in an active manner, i.e. within an active system of exploitation of the latter for 3 years from their collection or their updating in order to allow the commercial follow-up or the taking of attachment within the framework of possible recruitment, but also the update of the file Client/prospect of the company.
Beyond this period, the data are kept in an inactive way (storage without treatment) during 3 additional years (that is to say 6 years in total) in order to make it possible to justify the rights and obligations of the company in the event of legal dispute and in conformity with the time limits of prescription of the civil actions.
ARTICLE 6 – Hypertext links / Cookies
Article 6.1 – Hypertext links
The site https://ciel-et-terre.net/ peut presents outgoing hypertext links, however the web pages where these links lead do not engage the responsibility of the company which does not have the control of these links.
The User therefore refrains from engaging the responsibility of the site concerning the content and resources related to these outgoing hypertext links.
Article 6.2 – Cookies

PRIVACY POLICY FOR CANDIDATES OF CIEL & TERRE
When reviewing your application, your personal data will be processed by the Human Resources department of the Ciel & Terre company to which you are applying.
This Candidate Privacy Policy (“Policy”) provides a general overview of the processing activities carried out by Ciel & Terre in the context of managing its recruitment processes, in compliance with applicable legal requirements, and in particular Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“General Data Protection Regulation” or “GDPR”) and/or any other provisions arising from applicable national legislation, notably French Law No. 78-17 of 6 January 1978 on Information Technology, Data Files and Civil Liberties (together, the “Applicable Regulations”). It also includes a detailed description of these processing activities in Appendix 1.
Specific notices or privacy policies (“Specific Policy”) may be provided to you, if necessary, in particular situations where your personal data is processed by Ciel & Terre in ways not covered by this Policy.

1. What is our role?
The Ciel & Terre group company to which you are applying (hereinafter “Ciel & Terre” or “We”) acts as the data controller of your personal data in the context of reviewing your application.
Ciel & Terre determines the purposes for which your personal data is processed and the means allocated to such processing.

2. For what purposes do we process your data?
Your personal data is processed for the following purposes:
- to manage the recruitment process;
- to build a CV database*;
- to organize assessment sessions to evaluate your skills/aptitudes and personality;
- to exercise our rights in legal proceedings in the event of a dispute;
- to handle your personal data requests.
*Only with your consent: we may retain the information you provided during your application in order to contact you about future opportunities within the Ciel & Terre group. If you wish to withdraw your consent, you can submit a request to rgpd@cieletterre.net
3. What personal data do we collect?
Only personal information strictly necessary to assess your suitability for the role or your professional abilities will be requested during the selection process.
We may ask for details of your educational background, professional experience, skills, and professional aptitudes. In some cases, we may request that you take tests to evaluate your personality, knowledge, and abilities relevant to the role.
Failure to provide this information will make it impossible for you to participate in the recruitment process.
If your application is successful, we will ask for additional information and supporting documents necessary to complete the mandatory administrative formalities. Providing these is a condition for the conclusion of the employment contract.
Some information (such as civil status, address, social security number, residence permit, etc.) is required by law for successful candidates. Failure to provide this information will prevent us from concluding an employment contract.
4. How do we obtain your personal data?
Ciel & Terre may collect your personal data from various sources:
- Data you provide directly (e.g., in your CV, cover letter, or during interviews).
- Data obtained lawfully from third parties (e.g., recruitment agencies, test providers).
Unless otherwise indicated, providing your personal data is mandatory. If you refuse, we may not be able to review your application.
5. What is “sensitive personal data” and when do we process it?
Sensitive personal data may reveal:
- racial or ethnic origin,
- political opinions,
- religious or philosophical beliefs, or trade union membership,
- genetic data,
- biometric data used to uniquely identify a natural person,
- health data, or data concerning a natural person’s sex life or sexual orientation.
We do not process sensitive personal data during the review of your application.
However, if your application is successful, certain sensitive data (e.g., disability status – RQTH in France) may be requested.
6. What is the legal basis for processing your data?
We process your data on the following legal bases:
- Performance of pre-contractual measures: recruitment-related processing is necessary to take steps prior to entering into a possible employment contract with Ciel & Terre.
- Compliance with a legal obligation: in some cases, we must collect and use your data to meet our legal obligations (e.g., to allow you to exercise your data protection rights).
- Legitimate interests: where permitted under the Applicable Regulations, we may process your data in ways that do not override your rights and interests (e.g., requiring tests to assess skills for certain roles).

7. Automated decision-making
Unless otherwise stated in a Specific Policy, we do not use automated decision-making systems and will not make decisions about you solely by automated means.
8. How long do we retain your data?
- During the recruitment process: data is retained as long as necessary to complete it.
- If hired: your data will be included in your HR file and kept for up to five years after the end of your employment.
- If not hired: with your consent, your data may be stored in our CV database for two years from the last contact.
- For legal defense: data may be retained in intermediate archiving for up to five years after the end of the recruitment process.

9. With whom do we share your data?
Your data is treated confidentially within Ciel & Terre. Access is restricted to relevant departments (recruiters, managers, etc.).
If you are hired, certain data will be shared with external bodies notified of your employment (e.g., unemployment insurance, social security, pension, health insurance).
Access may also be granted to:
- service providers acting on our behalf (e.g., testing agencies),
- judicial or administrative authorities,
- our professional advisors (e.g., lawyers).
In all cases, Ciel & Terre requires recipients to:
- comply with the Applicable Regulations,
- process data only for the purposes described in this Policy, and
- implement appropriate technical and organizational security measures.
10. Where may your data be transferred?
Ciel & Terre is an international group with subsidiaries, partners, and service providers worldwide. For this reason, your data may be transferred outside the European Economic Area (EEA).
Where transfers occur, we ensure adequate safeguards are in place as required by data protection law, such as:
